Resident Notice: SPHA Proposed Lease Revision

Dear Resident,

 

During their meeting on October 26, 2023, the St. Petersburg Housing Authority (SPHA) Board of Commissioners approved the revision of the SPHA's current Lease.  The Lease is the legal contract between you and the St. Petersburg Housing Authority regarding your rental of the apartment.  The provisions of your Lease, as well as the policies of the Admissions and Continued Occupancy Policy, apply to your continued residency with the SPHA.

 

The Lease was revised to clarify rules regarding solicitation, trespassing and exclusion of non-residents, including the prohibition of illegal weapons.  The attachment to this letter, highlights the revision.

 

A draft of the new Lease Agreement will be posted on the SPHA's website. In addition, copies are posted and available for your review in the administrative offices of the SPHA located at 2001 Gandy Blvd. N., St. Petersburg, FL 33702.  Finally, printed copies will be located at the reception desk and your property offices. We encourage you to read the entire Lease.

 

You are invited to submit written comments regarding the revised Lease agreement by Monday, December 18, 2023.  Comments can be emailed to feedback@stpeteha.org, mailed to the Senior Vice President / Chief Operating Officer, St. Petersburg Housing Authority, 2001 Gandy Blvd. N., St. Petersburg, FL 33702 (must be postmarked by December 18, 2023), or hand-delivered to the Senior Vice President / Chief Operating Officer, at the administrative offices located at 2001 Gandy Blvd. N.  All comments received will be reviewed and maintained on file.  Unless significant comments are received by the above date, this Lease revision will be effective February 1, 2024.  Soon thereafter, you will receive further information from us regarding the process for your family's execution of the new Lease which must be completed by April 1, 2024.

              LEASE AGREEMENT SIGNIFICANT REVISIONS

 

We encourage you to read the entire draft Lease either on-line or through a posted, printed copy.  A draft of the new Lease Agreement will be posted on the SPHA's website.  In addition, copies are posted and available for your review in the administrative offices of the AHA located at 2001 Gandy Blvd. N.  Copies will be located at the reception desk and your property offices.

Below is the proposed revision to the lease:

 

 

Resident Obligations (17.cc.) - Removal

cc. Resident, with full knowledge of its right to bear arms under the Second Amendment to the United States Constitution and Article 1, Section 8, of the Florida constitution, and Section 190.25(3)(n) of the Florida Statutes, and intending to waive those rights, as additional consideration for its right to occupy the Premises, agrees not to display, use, or possess or allow members of Resident's household or guests to display, use or possess firearms (operable or inoperable) or other offensive weapons as defined by the laws and courts of the state of Florida anywhere on the Premises or elsewhere on SPHA property.

 

Solicitation, Trespassing, and Exclusion of Non-Residents (36) - Insertion

Landlord is committed to providing a safe and decent environment throughout the premises. Resident agrees to Landlord's reservation of the following rights to aid in providing a safe and decent environment throughout the premises:

 

A. Landlord reserves the right, to be exercised by its employees and authorized agents, to prohibit solicitation and/or trespassing on the premises by non-residents of Landlord unless the express written permission of Landlord is obtained in advance and in accordance with any applicable policies and/ or procedures of Landlord. Landlord shall exercise this right to the extent allowable by all applicable laws and/or regulations.

B. Landlord reserves  the right,  to be exercised by its employees  and authorized agents,  to exclude non-residents,  including but not limited to guests who (i) conduct themselves in a manner to disturb the residents' peaceful enjoyment  of their accommodations, community  facilities  or other areas of the premises; (ii) engage in illegal or other activity which would interfere with the health, safety or peaceful enjoyment of the premises by other residents of Landlord, Landlord's employees, persons residing in the immediate vicinity of the premises, representatives, contractors, agents, law enforcement officials and/or the public; (iii) engage in any criminal activity, that threatens the health, safety or peaceful enjoyment of the premises  by other residents of Landlord, Landlord's employees,  persons residing in the immediate vicinity of the premises, representatives, contractors, agents, law enforcement officials  and/or the public; (iv) engage in any type of activity, that threatens the health, safety or peaceful enjoyment of the premises  by other residents of Landlord, Landlord's  employees, persons residing in the immediate vicinity of the dwelling, representatives, contractors, agents, law enforcement officials and/or the public; (v) engage in drug-related criminal activity (as defined herein)  or violent criminal  activity  or any felony conviction on or off the premises; (vi) engage  in destroying, defacing, damaging or removing Landlord's equipment, vehicles and/or any part of the dwellings,  buildings, facilities, or other areas of the premises; (vii) engage in the illegal use or illegal possession of firearms and/or other offensive  weapons, as defined by the laws and courts of the State of Florida, anywhere on the premises; and/or  (viii)  intentionally violate necessary rules, regulations, policies and/or procedures set forth by Landlord for the benefit and wellbeing of Landlord's residents, employees,  representatives, contractors, agents, property, law enforcement officials and/or the public in effect at the time this Agreement  is entered into and hereafter promulgated  by Landlord of which such non- residents have been made aware of or should be aware of. Landlord will exercise this right to the extent allowable by all applicable laws and/or regulations.
